Terms and Conditions
Introduction
These Terms and Conditions apply to all offers, orders and agreements of Tenderflame B.V., registered at Ingenieur Lelyweg 8, 2031 CD Haarlem, the Netherlands. By placing an order with Tenderflame B.V. you agree to these terms.
1. General
1.1 These general terms and conditions apply to all offers, quotations, orders and agreements of Tenderflame B.V.
1.2 Deviations from these terms are only binding if agreed in writing.
1.3 Tenderflame B.V. reserves the right to amend these general terms and conditions. The amended terms will apply as soon as they are published on the website.
2. Offers and Agreements
2.1 All offers from Tenderflame B.V. are non-binding and may be revoked by us.
2.2 An agreement is concluded at the moment Tenderflame B.V. confirms the order in writing or by email.
2.3 Tenderflame B.V. reserves the right to refuse orders or to attach special conditions to the delivery.
3. Prices and Payment
3.1 All prices are in euros and include VAT, unless stated otherwise.
3.2 Payment can be made in the manner indicated during the ordering process.
3.3 For payment by bank transfer, a payment term of 14 days after the invoice date applies. In the event of late payment, the customer is in default and statutory interest will be due.
4. Delivery
4.1 Tenderflame B.V. strives to deliver the order within the stated delivery time. However, stated delivery times are indicative and not binding.
4.2 If a product is no longer available, Tenderflame B.V. will inform the customer as soon as possible and, where possible, offer an alternative or cancel the order.
5. Returns and Right of Withdrawal
5.1 The customer has the right to return the order within 30 days of receipt without giving a reason. The customer must notify Tenderflame B.V. of the return in writing or by email.
5.2 Returns will only be accepted if the product is returned unused and in its original packaging.
5.3 The costs of return shipments are at the customer’s expense.
5.4 Tenderflame B.V. will refund the purchase amount within 14 days of receiving the return shipment.
6. Warranty and Liability
6.1 Tenderflame B.V. guarantees that the delivered products meet the usual requirements and standards that can reasonably be applied to them.
6.2 The warranty period is 2 years after delivery, unless stated otherwise.
6.3 Tenderflame B.V. is not liable for damage resulting from improper use of the products.
6.4 The liability of Tenderflame B.V. is limited to the invoice amount of the relevant order.
7. Complaints Procedure
7.1 Complaints about the execution of the agreement must be submitted to Tenderflame B.V. fully and clearly within 7 days.
7.2 Tenderflame B.V. will respond to submitted complaints within 14 days. If a complaint requires a foreseeably longer processing time, Tenderflame B.V. will send an acknowledgement of receipt within the 14-day period along with an indication of the time within which the consumer can expect a more detailed response.
8. Privacy
8.1 Tenderflame B.V. respects the privacy of all users of its website and ensures that the personal information provided to us by the customer is treated confidentially.
8.2 Tenderflame B.V. uses the customer’s data to process orders as quickly and easily as possible. For other purposes, this information will only be used with the customer’s consent. 8.3 For more information about how we handle your data, please refer to our privacy policy.
9. Applicable Law and Disputes
9.1 Dutch law exclusively applies to all legal relationships to which Tenderflame B.V. is a party.
9.2 Disputes between Tenderflame B.V. and the customer will be submitted exclusively to the competent court in the Netherlands.
